BACKGROUND AND ANALYSIS
On March 13, 2020, the Town of Cutler Bay (the "Town") issued a Local State of Emergency in response to the worldwide Novel Coronavirus Disease 2019/COVID-19 ("COVID-19") pandemic. The Emergency Order was consistent with Declarations issued by Mayor Carlos A. Gimenez of Miami-Dade County (the "County"), Governor Ron DeSantis of the State of Florida, and President Donald J. Trump.
On March 13, 2020, the US Emergency Declaration authorized the Federal Emergency Management Agency ("FEMA") to provide appropriate assistance to local governments under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5121 et. seq. (the "Stafford Act"). Under the Stafford Act, eligible emergency protective measures taken to respond to the COVID-19 emergency at the direction or guidance of public health officials may be reimbursed through FEMA's Public Assistance program.
In response to the COVID-19 pandemic, the Town implemented emergency operation protocols to mitigate the spread of COVID-19. To date, the Town has spent over $237,000.00 to respond to the COVID-19 pandemic.
