AN ORDINANCE OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, EXTENDING THE MORATORIUM ADOPTED BY ORDINANCE 19-13; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
On July 17, 2019, the Town Council adopted Ordinance No. 19-13, which provided for a moratorium on development within the Town (Attachment "A").
Town staff is now requesting a three (3) month extension to the moratorium in order to review, workshop, and finalize the analyses and regulations for:
> Mobility
> Sustainability and Resiliency
> Architecture and Landscape
The adopted moratorium will expire on January 16, 2020 if not extended and although the consultants are in the final stages of their reviews it would be in the best interest of the Town to provide for additional public input via a community workshop process for all three Study areas.
The proposed three (3) month extension to the Building Moratorium Ordinance was advertised on November 7, 2019 in the Miami Herald local section. (Attachment "B").
The proposed community workshop is anticipated to take place in late January as there are no meetings scheduled for the month of December. The extension of the moratorium on development will expire on April 17, 2020.
RECOMMENDATION
It is recommended that the Town Council adopt the approval of the attached Ordinance adopting a three (3) month extension of the Moratorium on development applications.
