BACKGROUND AND ANALYSIS
Since the Town of Cutler Bay’s (the “Town”) incorporation, our Local Police Patrol Services have been contracted with the Miami-Dade County Police Department (the “MDPD”). The Town first contracted with the MDPD in 2006 at which time, the Town Council adopted Resolution No. 06-68. Subsequently in 2010 and 2014, the Town Council adopted Resolution No. 10-18 and Resolution No. 15-13, renewing each of the Local Police Patrol Services Interlocal Agreements (the “Agreement”) for a five (5) year term.
This year, Town staff has made a collaborative effort in positioning the negotiations with MDPD staff. In working with the managers from Town of Miami Lakes and the Village of Palmetto Bay, whom also contract their Local Police Patrol Services with MDPD, the Town has streamlined the final Agreement to include/enhance current services provided. In addition, both the Financial Director and I participated in all the MDPD negotiation sessions/meetings, in order to address any contractual concerns. In efforts to summarize some of the major “highlights” of the proposed Agreement, Town staff has created an Executive Summary for your review (Attachment “A”).
On July 17, 2019, the Town Council unanimously approved a “motion” authorizing the execution of a ninety (90) day extension for the Local Police Patrol Services Interlocal Agreement due to the final determination on certain revisions and/or updates of the current Agreement. On July 24, 2019, the Town Manager issued a revised letter to the MDPD Director, requesting an extension request of the current Agreement (expiring August 20, 2019) to November 18, 2019 (Attachment “B”). The term of the Agreement will be retroactive from November 2019 thru November 2024.
On August 8, 2019, the MDPD Director issued a letter to the Town stating that the MDPD does not have the authority to grant the extension and will submit the request to the Miami-Dade County Board of County Commissioners (BCC) for consideration of approval at their upcoming meeting (Attachment “C”).
On September 4, 2019, the BCC passed and adopted Resolution No. R-922-19, approving a 90-day extension of the existing Interlocal Agreement between Miami-Dade County and the Town of Cutler Bay, from August 21, 2019 through and including November 18, 2019, and retroactively authorizes the County Mayor or the County Mayor’s designee to execute such an extension to the Interlocal Agreement as provided herein (Attachment “D”).
On September 9, 2019 the Village of Palmetto Bay’s Village Council passed and adopted (via Resolution No. 2019-118) the Interlocal Agreement with Miami-Dade County for the provision of Local Patrol Services. On September 10, 2019, the Town of Miami Lakes’ Town Council passed and adopted (via Resolution No. 19-1635) the Interlocal Agreement with Miami-Dade County for the provision of Local Patrol Services.
In addition to the contractual side of our relationship with MDPD, Town staff reviews their Annual Operating Budget request, which is then presented to the Town Council during our Budget Workshop(s) and Budget Hearing(s). This annual review, allows both Town staff and MDPD, an opportunity to discuss several important fiscal impacts:

Ø Equipment Purchases
Ø Overtime Cost
Ø Replacement Vehicles
Although our Police Patrol Services are contracted out to the MDPD, our Police Command staff actively participates with Town staff during Monthly Staff meetings, Strategic Master Plan Meetings, Transportation Master Plan Meetings, Public Works Project Meetings, Special Events, Public School Outreach Meetings, Neighborhood Watch Meetings, etc.
Our Police Command Staff (Major Leonard A. Ricelli and Lieutenant Daniel Mendoza), take great pride and leadership in our Town, which is evident in the class of Police Officer(s) carefully chosen through a vigorous selection process, in order to be assigned to the Town. Additionally, I meet with our Police Command staff on a monthly basis, in order to discuss crime trends which may affect a particular neighborhood.
RECOMMENDATION
We recommend that the attached Resolution be adopted, approving the FY 2019-2024 Interlocal Agreement with Miami-Dade County for Local Police Patrol Services for an additional five (5) years of Service (2019-2024).
