AN ORDINANCE OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, ESTABLISHING THE CANDIDATE QUALIFYING PERIOD FOR THE 2020 MUNICIPAL GENERAL ELECTION AND ESTABLISHING THE RUN-OFF DATE, IF NECESSARY; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
The Town of Cutler Bay Town Council seats of Vice Mayor and Seat 2 will expire in November 2020. In order to establish a qualifying period for the municipal general election to be held on November 3, 2020 and to accommodate the requirements and deadlines set forth by Miami-Dade County Supervisor of Elections and the Town of Cutler Bay Town Charter, it is proposed that the qualifying period be established to begin 12 p.m. (noon) on July 24, 2020 and end on August 7, 2020 at 12 p.m. (noon).
At the January 16, 2019 Town Council Meeting the Town Council voted to select the date of December 1, 2020 as the date for a Run-off Election, if necessary. At the urging of the Miami-Dade County Supervisor of Elections office, the Town Council voted to set the date of December 1, 2020 for the Town of Cutler Bay Run-off election, if such run-off is necessary.
RECOMMENDATION
It is recommended that the Town Council adopt the ordinance establishing the official period for qualifying candidates for office for the seats of Vice Mayor and Seat 2 as 12 p.m. (noon) on July 24, 2020 through 12 p.m. (noon) on August 7, 2020 and officially set the Run-off election, if necessary for December 1, 2020.
