BACKGROUND AND ANALYSIS

 

Section 2-129 of the Town Code of Ordinances (“Code”) authorizes the Town Council to establish the agenda format and council meeting procedures by resolution.  The Town Council adopted Robert’s Rules of Order to govern procedure on February 2, 2006 via Town Resolution No. 06-05.

 

It is important to the Town and the residents that actions have a measure of finality, once the Town Council has deliberated and acted upon them. Without finality, an environment of instability and uncertainty may be created.  Therefore, there is a need to clarify that Robert’s Rules of Order governs questions of procedure which are not otherwise addressed.

 

The proposed rule permits exceptions in extraordinary circumstances and includes provision for a supermajority motion and vote.  In addition, the proposed rule will allow the Town Council to amend a prior action by motion and majority vote.  Only a motion to renew previously defeated items, or to repeal or rescind previously adopted items, would be affected. 

 

RECOMMENDATION

 

It is recommended that the Town Council adopt the attached Resolution, approving Rules of Procedure.
