BACKGROUND AND ANALYSIS

 

On May 2, 2012, the Town of Cutler Bay was one of two (2) local governments in the State of Florida selected by FEMA to receive a grant in the amount of $50,000 with a Town match of $68,000 to develop a “Town-wide” Floodplain Mitigation Plan.  The Town has been an active participant in the Federal Emergency Management Agency’s (FEMA) National Flood Insurance Program’s (NFIP) Community Rating System (CRS) Program, which encourages communities to voluntarily implement standards, policies, and programs that go above and beyond the minimum NFIP regulations in return for lower flood insurance premiums.  The successful development and implementation of the Town’s Floodplain Mitigation Plan means that the Town’s Community Rating System (CRS) property owners may quality for additional Flood Insurance discount rates.

The Town of Cutler Bay (the “Town”) adopted Resolution Number 12-56 on October 17, 2012, authorizing the issuance of a Request for Qualifications (RFQ) for Professional Services for the development of the Town’s Floodplain Mitigation Plan. On February 20, 2013, the Town awarded RFQ #12-03 to AMEC Foster Wheeler.  On June 20, 2013, the Town executed a Professional Services Agreement with AMEC Foster Wheeler for the development of the Town’s Floodplain Mitigation Plan via Resolution #13-14 (Attachment “A”). The Consultant, working closely with Town Staff and the Town’s Floodplain Mitigation Committee, developed the Town’s Floodplain Mitigation Plan which identifies seventeen (17) measures to reduce flooding throughout the Town. 

 

Prior to the development Floodplain Mitigation Plan, the Town has a CRS rating of six (6), which results in an annual savings of twenty percent (20%) to all property owners who purchase flood insurance policies. After review of the Town’s efforts in implementing the projects identified in the Floodplain Mitigation Plan, the Town has been informed that our community has sufficient credit points for a CRS rating of four (4).  This potentially saves Cutler Bay policy holders an additional $388,488.00 per year collectively.  A CRS classification rating of a 6 saves each policy holder on average $147, a class 5 saves $183, and a class 4 saves an average $220 on the cost of flood insurance annually (Attachment “B”-FEMA CRS Verification Report).

In order to earn the CRS Class Four (4) rating, the Town must meet the pre-requisite of developing and adopting a Watershed Master Plan.  If the Town decides not to meet this pre-requisite, then the Town will move from a Class Six (6) rating to a Class (5) rating.

The Town wishes to seek the maximum benefit to property owners by seeking the Class Four (4) rating.  To accomplish this goal, the Town wishes to extend the Professional Services Agreement with AMEC Foster Wheeler which expired on June 20, 2017 pursuant to Section XVII of the Agreement.  Due to the AMEC’s familiarity with the CRS Rating System/NFIP and the extensive work toward the completion of the Town’s adopted Floodplain Mitigation Plan, Town Staff feels that extending the contract for an additional two (2) year period will allow us to quickly develop the new Watershed Master Plan. 

 

RECOMMENDATION

 

It is recommended that the Town Council approve the attached Resolution, authorizing the Town Manager to execute an amendment to extend the duration of the Professional Services Agreement with AMEC Foster Wheeler Environment & Infrastructure, for an additional two (2) year period, not to exceed June 30, 2019, subject to approval by the Town Attorney as to form, content, and legal sufficiency.
