BACKGROUND AND ANALYSIS

The Town of Cutler Bay (the "Town") is requesting from the School Board of Miami-Dade County (the "School Board") to grant an easement for a public bus shelter located at: 8601 SW 212 Street, Cutler Bay, FL 33189 within the Town (Attachment "A").

The proposed construction for Phase I, shall strive to beautify the Town's image by removing four (4) existing aluminum bus shelters and unappealing advertisements that come with them, and replacing them with three (3) decorative bus shelters. Two (2) of the existing aluminum bus shelters sites will be consolidated into one (1) bus shelter site due to their close proximity from each other. An additional eight (8) decorative bus shelters will be installed at existing bus stop locations with no shelter, for a grand total of eleven (11) decorative bus shelters. However, one of the proposed bus shelters is located in the School Board's property in accordance with the bus shelters project plans.

In order to install the planned bus shelter, the Town requires an area of approximately three hundred twenty-two (322) square feet inside the School Board's property for the construction, operation and maintenance of a new bus shelter. School Board staff has reviewed the Town's request and has no concerns/issues granting the non-exclusive easement property over to the Town.
