A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, APPROVING DISCOUNTED FENCE PERMIT FEES DUE TO DAMAGE CAUSED BY HURRICANE IRMA; PROVIDING FOR AUTHORIZATION; AND PROVIDING FOR AN EFFECTIVE DATE.

body.

BACKGROUND AND ANALYSIS

Hurricane Irma was declared a major hurricane with maximum sustained winds of 120 mph on Monday, September 4, 2017. The forecast from the National Hurricane Center predicted that Hurricane Irma would make landfall in South Florida as a major hurricane. Hurricane Irma posed a severe threat to the entire State of Florida and required timely precautions to be taken to protect the communities, critical infrastructure, and general welfare.

Subsequently, State of Emergency was declared by Governor Rick Scott of the State of Florida, Executive Order No. 17-235 effective on September 4, 2017 and by Mayor Carlos Gimenez of Miami-Dade County effective on September 5, 2017. A State of Emergency for the Town of Cutler Bay was declared on September 6, 2017 and was terminated on September 18, 2017 as conditions causing the emergency no longer existed and the Town’s departments were able to manage the situation without extraordinary assistance.

In an effort to assist the Town’s property owners who have been affected by Hurricane Irma, the Town Council desires to discount permit fees thirty percent (30%) through December 31, 2017 for fence repairs related to Hurricane Irma, which is the amount retained by the Town pursuant to its agreement with C.A.P. Government, Inc.

RECOMMENDATION

It is recommended that the Town Council adopt the attached Resolution, discounting fence permit fees due to damage caused by Hurricane Irma.
