A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE TOWN OF CUTLER BAY FOR MAINTENANCE OF CERTAIN IMPROVEMENTS ALONG SOUTH DIXIE HIGHWAY (US-1) AND SW 200 STREET (CARIBBEAN BOULEVARD); PROVIDING FOR AUTHORIZATION; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
The Florida Department of Transportation (FDOT) is developing the design for a safety improvement project (the "Project") along State Road 5/US 1 at SW 200 Street (Caribbean Boulevard), located within Town limits. The Project goals are to improve public safety, ease traffic congestion, enhance traffic flow, enhance pedestrian mobility, improve function and flow of mass transit, and beautify the neighborhood with streetscape improvements.
The following "improvements" are identified in the Project:
* Providing high emphasis crosswalks at the intersection;
* Adding median with landscape and steel loop fence;
* Removing existing four (4) foot wide traffic separator and reduce lane widths to provide wider medians;
* Installing pedestrian signage;
* Repaving and restriping the roadway; and
* Adding lighting to the northwest and southwest corner of the intersection.
The FDOT is requesting that the Town maintain the landscape within the specified limits. As part of the FDOT Landscape and Turf Maintenance Memorandum of Agreement ("Maintenance Agreement") with the Town, the Town agrees to maintain the obligations stated therein (see Maintenance Agreement attached hereto as Attachment "A").
