A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, AUTHORIZING THE TOWN MANAGER TO AMEND THE CONTRACT WITH ACOSTA TRACTORS INC. FOR THE CONSTRUCTION SERVICES FOR THE CARIBBEAN BOULEVARD ROADWAY IMPROVEMENT(S) - GAP #1 (FROM C-100 BRIDGE TO CORAL SEA ROAD) PROJECT; AND PROVIDING AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
At the March 19, 2008 Town Council meeting, Resolution # 09-17 was adopted approving a Joint Participation Agreement (the "JPA") with Miami-Dade County to facilitate the construction of roadway improvements along Caribbean Boulevard (Project Limits: Coral Sea Road to SW 87 Avenue). Subsequently, the Miami-Dade Board of County Commissioners, on April 7, 2009 adopted Resolution # R-353-09, approving the Caribbean Boulevard JPA.
The Caribbean Boulevard Roadway Improvement "original" Project limits were decided by the fact that, the Caribbean Boulevard Bridge widening Project limits were planned to end on Coral Sea Road. The Caribbean Boulevard Bridge widening Project was in the planning phase, for several years due to permitting and design issues. Due to budgeting concerns, the Caribbean Bridge widening Project's limits were reduced, to only several 100 feet (east and west) from the C-100 canal. The reduction of the Bridge Project, created a "gap" adjacent to the Town's JPA Roadway Improvement Project (Gap #1: C-100 Bridge to Coral Sea Road) (Attachment "A").
On November 20, 2013 the Town adopted Resolution No. 13-93, approving the First Amendment to the JPA between Miami-Dade County and the Town relating to the Caribbean Boulevard Roadway Improvement Project (Attachment "B").
On December 1, 2014, as per Section 1.5 of the Caribbean Boulevard from Coral Sea Road to SW 87 Avenue Joint Participation Agreement (JPA), the Town requested from the County concurrence for Acosta Tractors to proceed with the Construction of GAP #1 (from C-100 Bridge to Coral Sea Road) and extending the applicable unit prices awarded in the Town's ITB #13-04 approved by Town Resolution #13-04 (Attachment "C"). This resulted in Miami-Dade County's concurrence letter dated on December 19, 2014 (Attachment "D").
Acosta Tractors, Inc. has agreed to uphold the previous Unit Bid Prices as applicable and has provided the Town with a cost breakdown bid form proposal for a total construction cost for Gap #1 of $ 2,216,099.72 (Attachment "E"). As per the first amendment to the Joint Participation Agreement for Caribbean Boulevard from Coral Sea Road to SW 87 Avenue, Miami-Dade County has agreed to fund $ 1,834,215 of the construction cost for Gap #1 (Attachment "F") and the remaining $ 381,884.72 will be funded by the Town's potion of the People's Transportation Plan - municipal allocation.
RECOMMENDATION
It is recommended that the Town Council approve the attached Resolution approving the first amendment to the Contract with Acosta Tractors, Inc. for the Caribbean Boulevard Roadway Improvement(s) Project - Gap #1 (From C-100 Bridge to Coral Sea Road).
