BACKGROUND AND ANALYSIS
The Town of Cutler Bay’s (the “Town) Public Works Department (“Department) is responsible for overseeing various Capital Improvement Projects and conducting various studies. The Department manages General Civil Engineering, Transportation Planning, Engineering, Stormwater Utility Engineering, Landscape Architecture and other Public Works related activities.
On May 21, 2014, the Town Council adopted Resolution No. 14-32, authorizing staff to issue a Request for Qualifications (“RFQ”), to identify the best available consultants to assist the Town with Professional Engineering Services (“Services”). On May 30, 2014, the Town issued RFQ No.14-05 Professional Engineering Services.
On September 17, 2014, the Town Council adopted Resolution No. 14-63, approving the qualifications of Marlin Engineering, R. J. Behar & Company, Inc., and Stantec Consulting Services, Inc. (the “Consultants”), to provide Services for the Town and authorizing the Town Manager to enter into a Professional Services Agreement (the “Agreement”). On January 2, 2015, the Town entered into an Agreement with the Consultants for the Services (Attachment “A”).
As stated in the Agreement under Section XVII - Duration of Agreement, “The Agreement term will be for three (3) years, with the option for the Town to extend the agreement for an additional two (2) one-year terms.” At its sole discretion, on January 2, 2018, the Town extended the Agreement upon the same terms and conditions and implemented the “Renewal Option” of Agreement. All consultants accepted renewal and Agreement remained in full force and effect until January 2, 2020 (Attachment “B”).
The Town wishes to extend its Agreement with the Consultants for an additional four (4) months ending May 2,2020 with the same terms and conditions, to perform Services until new Agreements are procured and executed.
RECOMMENDATION
It is recommended that the Town Council authorize the Resolution to amend the 2014 Agreement pursuant to the terms in substantially the form as proposed in Exhibit “A” to the Resolution.
