A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, APPROVING THE SECOND AMENDMENT TO THE JOINT PARTICIPATION AGREEMENT BETWEEN MIAMI-DADE COUNTY AND THE TOWN RELATING TO THE CARIBBEAN BOULEVARD ROADWAY IMPROVEMENT(S) PROJECT; AUTHORIZING THE TOWN MANAGER TO EXECUTE THE REQUIRED DOCUMENTS; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
At the March 19, 2008 Town Council meeting, Resolution # 09-17 was adopted approving a Joint Participation Agreement (the “JPA”) with Miami-Dade County to facilitate the construction of roadway improvements along Caribbean Boulevard (Project Limits: Coral Sea Road to SW 87 Avenue). Subsequently, the Miami-Dade Board of County Commissioners, on April 7, 2009 adopted Resolution # R-353-09, approving the Caribbean Boulevard JPA.
The Caribbean Boulevard Roadway Improvement “original” Project limits were decided by the fact that, the Caribbean Boulevard Bridge widening Project limits were planned to end on Coral Sea Road. The Caribbean Boulevard Bridge widening Project was in the planning phase, for several years due to permitting and design issues. Due to budgeting concerns, the Caribbean Bridge widening Project’s limits were reduced, to only several 100 feet (east and west) from the C-100 canal. The Town entered into an agreement with Miami-Dade County for Gap 1 (C-100 Canal to Coral Sea Road), via Resolution 13-93, approved on November 20, 2013. The reduction of the Bridge Project, created a second “gap” adjacent to the Town’s JPA roadway improvement project (Gap 2: Homestead Extension of Florida’s Turnpike to C-100 Canal).
Town staff has been negotiating for several months with Miami-Dade County Public Works staff, to consider funding the second “gap”, in order to complete the Caribbean Boulevard roadway improvement project.
The Old Cutler Road Joint Participation Agreement (#20090089) project was finalized with a remaining surplus of funds totaling $1,601,039. The Town has requested Miami-Dade County to use the surplus funds from the Old Cuter Road JPA for the design and construction of roadway improvements as a funding source towards Caribbean Boulevard Gap #2 (from Homestead Extension of Florida’s Turnpike to Canal C-100).
Both Town staff and consulting engineers, estimate the “gap” design and construction costs to total approximately: $1,065,330.20 which, include enhancements to the standard roadway project. The enhancement costs total approximately: $ 66,300.00 which, will be funded through the Town’s People’s Transportation Plan municipal allocation (Attachment “A”).
The Town agrees to fund any remaining deficit within the Second Amendment’s Project Limits, previously referred to as the “gap”, in order to expedite the construction of a road improvement(s) and enhancement(s) project (from Homestead Extension of Florida’s Turnpike to Canal C-100) along Caribbean Boulevard.
Funding for the proposed Second Amendment to the Joint Participation Agreement: Caribbean Boulevard Project, is being provided by the Town’s portion of People’s Transportation Plan municipal allocation.
RECOMMENDATION
It is recommended that the Town Council approve the attached resolution approving the Second Amendment to the Joint Participation Agreement - Caribbean Boulevard Roadway Improvement(s).
