A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, APPROVING PARK USE AGREEMENTS WITH VARIOUS LOCAL YOUTH SPORTS ORGANIZATIONS FOR USE OF TOWN PARKS FOR SPORTS AND RECREATIONAL ACTIVITIES; PROVIDING FOR AUTHORIZATION; AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
Various Youth Sports Organizations (the “Leagues”) wish to utilize certain Town Parks for general recreation programs, sports activities and events for the use and benefit of the residents of the Town of Cutler Bay (the “Town”).
Town Resolution No. 07-42 authorized the Town Manager to enter into Park Use Agreements (the “Agreements”) with five (5) Leagues, authorizing them to operate programs in the Town’s Parks.
1. Cutler Ridge Soccer Incorporated at Cutler Ridge Park;
2. the Homestead Wahoo’s Swim Club, Inc. and Cutler Ridge Riptides Parent Booster Club, Inc. at Cutler Ridge Pool;
3. the Perrine Baseball and Softball Association, Inc. at Franjo Park;
4. the Palmetto Raiders Youth Development Club, Inc. at Bel Aire Park; and
5. Cutler Ridge Soccer Incorporated will utilize one (1) full size soccer field at Lakes by the Bay Park.
These Leagues have shown themselves to be capable of providing the resources necessary to conduct all facets of well-run programs, from registration and fund raising to scheduling and officiating games, while the Town provides for facilities and general maintenance.
According to Stanford Children’s Health, playing sports has a range of physical, emotional, and interpersonal benefits for children and adults of all ages. Some of the benefits include without limitation, the development of motor and social skills, team building, confidence, friendship, sportsmanship, and mutual respect.
The Town is committed to enrich its Leagues by providing them access to Town Parks’ facilities, which is an act consistent with the Town’s adopted Strategic Master Plan Goal 7.1, “to develop parks and recreational facilities and recreational programs to meet the current and emerging needs of residents of all ages.”
Each Agreement provides for the following:
• A three (3) year term, renewable for an additional three (3) years subject to mutual written agreement of both parties.
• Each League must be maintained as a non-profit organization.
• Each League must comply with Town Ordinance 06-33 - the “Shannon Melendi Act of Miami-Dade County”.
• Each League must provide an insurance certificate naming the Town as an Additional Insured.
• Each League is permitted to conduct concession operations at their respective facility.
• Each League is responsible for providing security during its use of the licensed facility.
• Each League is responsible for litter and debris removal following each day of activities.
• The Town will continue to provide for all routine maintenance necessary for the upkeep of the Parks.
• The Town will continue to pay for all electrical and water use at each of the Parks.
• Each League will continue to make an annual payment to the Town to help offset a portion of the Town’s direct costs for the operation of the Parks (each organization’s fee differs depending on the amount of Town resources directed toward the League’s programs).
Town Staff believes that the attached Agreements will allow the five (5) current Leagues (Cutler Ridge Soccer Incorporated, Homestead Wahoo’s Swim Club, Inc., Cutler Ridge Riptides Parent Booster Club, Inc., Palmetto Raiders Youth Development Club, Inc., and Perrine Baseball and Softball Association, Inc.) and potential future users to provide quality sports programs for Town residents, while providing for reasonable assurance that the programs do not cause an undue burden on the Town.
RECOMMENDATION
Town Staff recommends the adoption of the attached Resolution, which authorizes the Town Manager to execute the approved Park Use Agreements with the local Leagues (Cutler Ridge Soccer Club, Inc., Homestead Wahoo’s, Cutler Ridge Riptides Parent Booster Club, Inc., Palmetto Raiders Youth Development Club, Inc., Perrine Baseball and Softball Association, Inc.) for sports and recreational program activities.
