AN ORDINANCE OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CUTLER BAY, FLORIDA, AMENDING CHAPTER 30 “TRAFFIC AND MOTOR VEHICLES” REGARDING GOLF CART USE ON STREETS WITHIN THE TOWN; DELETING EXHIBIT “A” TO ORDINANCE 10-03; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICT, AND PROVIDING FOR AN EFFECTIVE DATE.

BACKGROUND AND ANALYSIS
On February 17, 2010, the Town adopted Ordinance No. 10-03 (Attachment “A”) on Second Reading, which provided for comprehensive regulations relating to the use of golf carts on designated streets within the Town.
Recently, the State Legislature amended Section 316.212(1) of the Florida Statutes to allow for the operation of golf carts on a “a two-lane county road located within the jurisdiction of a municipality designated by that municipality.”
Town Staff desires to amend Ordinance No. 10-03 to coincide with the amendments made by the State Legislature.
RECOMMENDATION
It is recommended that the Town Council adopt the attached Ordinance as amended.
